Dear Ms. Brooks and Mr. Roth,
The Chair of the HRAP has instructed me to advise both parties that a hearing will be held to determine the sole question as to whether the HRAP has jurisdiction to hear this matter. The burden of establishing jurisdiction will be on the party invoking the HRAP’s jurisdiction, viz. the Horse Peoples Alliance of Ontario.
I have also been instructed to advise that the parties will be required to serve and file Hearing Briefs not less than 5 days prior to the hearing date in accordance with rule 13.1 of the HRAP’s Rules of Procedure.
As to the hearing date, as Mr. Roth is out of the jurisdiction until the end of January 2018, I will be in touch with both of you soon after his return.
